Service Description
South Dakota Pest Control provides residential and commercial pest management services throughout the state of South Dakota. Our services include, but are not limited to, inspection and identification of pest infestations, application of pesticides and integrated pest management solutions, exclusion services, rodent control, insect control, wildlife management, and ongoing monitoring and maintenance programs. We tailor our treatment plans based on property conditions, environmental factors, and the specific pest species identified during our initial assessment. Service frequency, methods, and products used may vary depending on seasonal pest pressures, regulatory requirements, and the unique characteristics of your property. All services are performed by licensed applicators in accordance with South Dakota Department of Agriculture regulations and federal EPA guidelines. We reserve the right to modify service protocols as needed to achieve effective pest management while maintaining safety standards for occupants, pets, and the environment.
No Guarantee or Warranty
South Dakota Pest Control does not guarantee complete elimination of all pests from any property. Pest management outcomes depend on numerous variables beyond our reasonable control, including but not limited to: neighboring property conditions, structural defects, weather patterns, sanitation practices, and reintroduction of pests by occupants or visitors. We do not warrant that our services will prevent future infestations or that treated areas will remain pest-free for any specific duration. Our recommendations for structural repairs, sanitation improvements, or behavioral changes must be implemented by the customer to optimize treatment effectiveness. Wood-destroying organism inspections are conducted in accordance with industry standards but are not guarantees against hidden damage or future infestations. Any warranties for specific services, where offered, shall be limited to the express written terms provided at the time of service and shall not exceed the value of the treatment applied.
User Responsibilities
Customers must provide accurate information regarding property conditions, existing pest problems, prior treatments, and known allergies or sensitivities of occupants and pets. You must ensure safe access to all areas requiring treatment and secure or remove pets, children, and sensitive items as directed by our technicians. Customers are responsible for following all post-treatment instructions, including ventilation requirements, re-entry timelines, and cleaning restrictions. Failure to prepare areas as instructed may result in incomplete treatment, additional charges, or rescheduling fees. You must promptly report any adverse reactions, incomplete results, or new pest activity within the specified callback period. Customers must not interfere with treatment applications, bait stations, or monitoring devices placed by our technicians. Payment is due according to the terms specified in your service agreement, and customers remain responsible for charges incurred regardless of perceived treatment outcomes.
Limitation of Liability
To the maximum extent permitted by applicable law, South Dakota Pest Control shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, loss of use, lost profits, or emotional distress. Our total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim during the twelve months preceding the incident. We are not liable for damage to personal property, landscaping, or structures resulting from pre-existing conditions, inadequate customer preparation, or failure to follow post-treatment instructions. We assume no liability for pest-related damage to structures, belongings, or health that occurs before, during, or after treatment. This limitation applies regardless of the legal theory asserted, whether contract, tort, negligence, strict liability, or otherwise.
Intellectual Property
All content on our website, marketing materials, service reports, treatment plans, and proprietary application techniques are the exclusive intellectual property of South Dakota Pest Control. Customers may not reproduce, distribute, modify, create derivative works from, or commercially exploit any materials without our prior written consent. Service reports and documentation provided to customers are licensed solely for personal reference and insurance purposes and may not be used to procure services from competing providers or for regulatory submissions without our authorization. Our trade names, logos, service marks, and branding elements are protected under applicable trademark laws. Unauthorized use of our intellectual property constitutes infringement and may result in legal action.
Governing Law
These Terms of Service and any disputes arising from our services shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in South Dakota, and customers consent to the personal jurisdiction and venue of such courts. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods shall not apply. If any provision of these terms is held invalid or unenforceable under South Dakota law, the remaining provisions shall continue in full force and effect.
Changes to Terms
South Dakota Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Changes become effective upon posting to our website or upon your acceptance of updated terms for ongoing services. Material changes to pricing, liability limitations, or dispute resolution procedures will be communicated to active customers at least thirty days before implementation. Your continued use of our services following any changes constitutes acceptance of the revised terms. We encourage customers to review these terms periodically. The most current version will always be available upon request and will supersede all prior versions.
